A Land Mine in Rule 12(c) Motions for Judgment on the Pleadings

Abstract
The use-or-lose attribute of the waivable Rule 12(b) defenses and objections is known to all civil practitioners. But the fact that a timely-asserted Rule 12(b) defense can be waived by omitting it from a later-filed Rule 12(c) motion for judgment on the pleadings can represent an unanticipated land mine in federal practice.
