Abstract

This article addresses the status of charter schools and legal issues related to operating those schools. The sine qua non of charter school operations is public funds which requires that charter school officials submit reports containing information on attendance. While the responsibility of charter school officials to submit reports is clear, what is not always clear is the extent to which charter schools are the same as, or different from, public schools. Fundamental questions can concern such matters as to whether charter schools are public entities, the measure of liability for inaccurate reports, and the standard for compliance with discrimination statutes. The discussion begins with the recent Supreme Court of Ohio decision, Cordray v. International Preparatory School (Cordray).
