Liability for delay in multimodal transport under the Rotterdam Rules

Abstract

Liability for delay is a topical issue in the law of carriage of goods mainly because not much scholarly work has been devoted to it. The probable reason is because there are no provisions in the Hague-Visby Rules adressing delay. This article looks at liability for delay in respect of carriage under unimodal Conventions and then focuses on the Rotterdam Rules where liability for delay is covered. The author concludes that provisions pertaining to liability for delay are not adequately harmonised in transport law nor in multimodal transportation in particular.
