Client Perjury Under the New Rules of Professional Conduct

Abstract

On April 1, 2009, New York adopted new Rules of Professional Conduct. Rule of Professional Conduct 3.3 represents a significant change over its predecessor rule under the Code of Professional Responsibility, and will impose a greater obligation upon counsel to take remedial action upon having knowledge of prior client perjury. If remonstration with the client fails to work, the new rules require withdrawal of the false testimony, even if in so doing the lawyer reveals client confidences.
