Garbage In: Emerging Media and Regulation of Unsolicited Commercial Solicitations

Abstract

The article considers modalities of regulating unsolicited commercial solicitations via email by comparing legal regulation of other forms of unsolicited commercial solicitations. Specifically, it argues that a labeling regulation for spam would be constitutional.
