Remands By Deception

Abstract
Federal statutory law sharply limits the judiciary's ability to revisit rulings that remand a removed case back to its originating State court. This article finds that "vacating" such remand orders should be permitted if they are found to have been deceptively induced by litigant misrepresentations made to the remanding court.
