Abstract

Perhaps the most important signal given by this decision is the symbolic point that it is authored by "The Court". Jordan was a five-four split between quite different positions, and so that left room for doubt about how firm the Court's commitment to its radically new approach might be: this unanimous judgment of seven members of the Court in Cody with no identified author makes apparent in the clearest terms that all the members of the Court are solidly behind the change.
