El principio de Estado Social en la Constitución chilena

Abstract
The attainment of social justice does not depend on the enactment of social rights or a social state principle in a given constitution. Legal scholars, as such, do not possess the knowledge or the powers to determine what a society needs in socio-economic terms. Comparative and national experience shows that the existence and success of a social welfare system depends on complex factors, which do not necessarily are related to the existing constitutional norms. Finally, it is discussed whether there is a clause of social state in the Chilean Constitution and what the practical effects would be of its existence.
