BOOK REVIEW - Christina Bohannan, Herbert Hovenkamp, Creation Without Restraint: Promoting Liberty and Rivalry in Innovation
European Intellectual Property Review (2012)
  • P. Sean MORRIS, University of Helsinki
Abstract

Modern intellectual property rights is no longer about the core rights of example copyrights or patents, but rather the effective remedies to combat the frequent interaction of such rights with other regulatory areas such as antitrust law. With the exponential growth of the discipline of intellectual property rights over the last decade, the core literature on intellectual property rights has shifted to other grounds, and justifying intellectual property rights is not so much about “originality” or “nonobviousness” but rather about fairness.
