Abstract
Through a comparative empirical approach, we can learn much about high court behavior. Among the key insights is whether and under what conditions these influential courts can check other political actors, protect minority interests, and have an active role in policymaking. However, progress on this kind of research has been slow because conducting large-scale comparisons among national high courts is exceedingly difficult. To date, the judicial behavior research has predominantly focused on single court analyses or comparisons among only a small number. Furthermore, some courts and regions remain significantly understudied because it is difficult to gather the needed information about these courts and their decision-making processes. In short, the practical barriers to studying judicial behavior are daunting. In this edited volume, we provide a more unified approach for developing theories about judicial behavior that travel across borders. The volume then outlines the evolution and current status of quantitative scholarship on high court behavior in each region of the world. The commentary focuses on the particular strengths and challenges of this regional research. Using this as a backdrop, the book suggests clear strategies to overcome the challenges of comparative empirical work, charting a path forward in this growing and exciting field of research.
