Abstract

This essay deals with a critical approach to a recent reform concerning financial sustainability of social assistance policies against material deprivation. Namely the analysis focuses the linkages between art. 38 (1) and art. 81 and 97 of the Italian Constitution. At first sight, the analysis deals, on one hand, with the s.c. proportionality test between social rights and financial sustainability and, on the other, with the ruling competencies’ frame of State-Regions. In this article the Author argues how such proportionality test can be carried out in our legal system, the limits of such competencies’ frame, the extent to which a person can be supported in order to valorize his/her labor power in the market to satisfy his/her most basic needs. In this perspective, the Author explores the Italian system of social security assistance schemes and the related recent case law. The essays concludes that a multi-dimensional approach of a welfare regime may better respond to basic needs of the people and to protection of dignity and freedom
