Irish High Court upholds the right to reside test - Munteanu v Minister for Social Protection(2017)
In Munteanu, the Irish High Court rejected a challenge to the legality of the right to reside test in Irish social welfare law. The Court correctly held that the test was not incompatible with EU law. The ruling is clearly correct in the light of the judgements of the CJEU in Dano and subsequent rulings. This note outlines briefly the issues at question and the judgement. Section 1 sets out the facts and the law and section 2 the Court’s approach. Section 3 concludes.
