O CONSELHO NACIONAL DE JUSTIÇA E OS INSTRUMENTOS DE CONTROLE DE CUMPRIMENTO DE SUAS POLÍTICAS PÚBLICAS JUDICIÁRIAS PELOS TRIBUNAIS BRASILEIROS

Abstract
O presente trabalho consiste em uma pesquisa documental e bibliográfica acerca da atuação do Conselho Nacional de Justiça no controle da autoridade de suas decisões, bem como dos atos normativos editados e das políticas públicas formuladas por ele, em face dos órgãos e tribunais que integram o Poder Judiciário brasileiro. O estudo tem o objetivo de investigar os mecanismos de controle exercidos pelo Conselho Nacional de Justiça, bem como a eficácia de tais instrumentos. A metodologia empregada foi o levantamento de dados e a pesquisa documental na identificação e estudo de casos concretos envolvendo os tribunais brasileiros, nos procedimentos de Acompanhamento de Cumprimento de Decisão e de Reclamação para Garantia de Decisões, bem como a pesquisa bibliográfica. Todos os processos instaurados mediante essas duas classes processuais foram analisados, adotando-se o período de janeiro de 2019 a setembro de 2021 como recorte temporal, no qual houve aumento da atividade normativa do CNJ, além de sua consolidação como órgão administrativo que ocupa posição hierárquica perante todos os órgãos judiciais e tribunais. A partir dos dados e das informações coletadas com a pesquisa, observou-se que os instrumentos de controle dos atos normativos e das políticas públicas, do CNJ, apresentam limitações e não têm permitido uma eficácia total para o cumprimento de suas decisões e de programas normativos instituídos pelo Poder Judiciário.

The present work consists of a documental and bibliographical research about the performance of the National Council of Justice in the control of the authority of its decisions, as well as the normative acts edited and the public policies formulated by it, in face of the organs and courts that make up the Power Brazilian Judiciary. The study aims to investigate the control mechanisms exercised by the National Council of Justice, as well as the effectiveness of such instruments. The methodology used was data collection and documentary research in the identification and study of specific cases involving Brazilian courts, in the procedures for Monitoring Compliance with Decisions and Complaints to Guarantee Decisions, as well as bibliographical research. All processes brought by these two procedural classes were analyzed, adopting the period from January 2019 to September 2021 as a time frame, in which there was an increase in the CNJ's normative activity, in addition to its consolidation as an administrative body that occupies a hierarchical position before all judicial bodies and courts. From the data and information collected with the research, it was observed that the instruments for controlling regulatory acts and public policies, of the CNJ, have limitations and have not allowed full effectiveness in complying with its decisions and established normative programs by the Judiciary.
