O presente artigo desenvolve o argumento de que a irretroatividade da alteração da jurisprudência (prospective overruling), tema que foi expressamente introduzido no novo Código de Processo Civil, deve se constituir regra, não a exceção, para todos os órgãos do Poder Judiciário, como concretização dos preceitos constitucionais de segurança jurídica, proteção da confiança e isonomia. Nesse sentido garantista da ordem constitucional, a partir do estudo de alguns institutos da Teoria dos Precedentes, defende-se a validade do § 3.º do art. 927 do NCPC, como também ampliação do seu conteúdo, a partir de uma interpretação conforme a Constituição, de modo a assegurar, como regra, a irretroatividade da mudança da jurisprudência, bem como a possibilidade de seu exercício por qualquer tribunal.

This article argues that the non-retroactivity of the amendment of the jurisprudence (prospective overruling), a theme that has been expressly introduced in the new Brazilian Civil Procedure Code, should therefore be the norm rather than the exception, for all judicial courts, as the achievement of the constitutional principles of

legal security, protection of dependability and equality. In this “guarantism” sense of the constitutional order, according to the study of some institutes of the Theory of Precedent, advocates the validity of § 3 of Art. 927 of the new Brazilian Civil Procedure Code, as well as the expansion of its contents in agreement with an interpretation under

the Constitution, to ensure, as a rule, the non-retroactivity of the amendment of the

jurisprudence, and the possibility of its exercise by any court.
