O estudo busca explorar a relação entre a prova oral e o problema da verdade no direito processual, a partir da perspectiva metodológica do construtivismo lógico-semântico. O exame do referencial teórico permitiu observar que o processo de percepção humana é marcadamente intersubjetivo e comunicacional. A linguagem assume, assim, papel preponderante na reconstrução dos eventos, por meio da afirmação de fatos jurídicos pelos sujeitos processuais, dentro das regras estabelecidas pelo sistema. As provas orais constituem exemplo desse fenômeno, uma vez que sua produção não implica aproximação ou distanciamento da verdade absoluta, nunca

possível de alcance. Assim, o estudo permite concluir que a verdade que se apresenta possível de se atingir é a lógico-semântica, que é o resultado de um rigoroso processo analítico dos elementos discursivos e das demais fontes cognitivas disponíveis.

The paper seeks to explore the relationship between the oral evidence and the problem of truth in procedural law, from the methodological perspective of logical-semantic constructivism. The examination of the theoretical reference allowed to observe that the process of human perception is markedly intersubjective and

communicational. Language thus assumes a preponderant role in the reconstruction of events, through the affirmation of legal facts by the procedural subjects, within the rules established by the system. Oral evidence is an example of this phenomenon, since its production does not imply approximation or distancing from absolute truth, never possible to reach. Thus, the study allows us to conclude that the truth that is possible to achieve is logical-semantics, which is the result of a rigorous analytical process of the discursive elements and other available cognitive sources.
