O presente artigo objetiva explorar aspectos relevantes da formação e organização do Poder Judiciário no Brasil durante os períodos colonial e imperial, em ordem a oferecer uma compreensão crítica das características das instituições judiciárias contemporâneas. Privilegiando o recurso histórico na investigação, buscou-se destacar a importância do papel dos magistrados, enquanto integrantes da elite da burocracia oficial, nos programas políticos da época, bem como a influência que o pensamento político exerceu nas diversas propostas de reforma

judiciária realizadas no período estudado, o que permitiu observar que as diversas opções de organização da magistratura, adotadas pela metrópole e, depois, pelo Império, levaram em conta, de forma pendular, a tendências por maior ou menor centralização do poder político.

This article aims to explore relevant aspects of the formation and organization of the judiciary in Brazil in the colonial and imperial periods, in order to provide a critical understanding of the characteristics of contemporary judicial institutions. Emphasizing the historic resource in the investigation, it sought to highlight the important role of judges as members of the elite of the official bureaucracy, the political programs of the time, and the influence that the political thought exerted in the various judicial reform proposals in the period studied, which allowed us to observe that the various options for organizing the judiciary, adopted by Metropolis and then the Empire, took into account, in pendulum way, the trends for greater or lesser centralization of political power.
