Mediation: The Romantic Days Continue

Abstract
This article reflects on South Texas College of Law’s Symposium on The Lawyer’s Duties and Responsibilities in Dispute Resolution and draws out the common ADR themes and shared visions for the field among the scholars and practitioners present. Fueled by the Symposium’s opening remarks that "[t]he romantic days of ADR appear to be over," the article offers a summary of the commonalities that may be foundational consensus points for mediators, a discussion of why defining and refining core values is a preliminary task to resolving ethical questions, and ultimately a conclusion that, if a common ground is reached about the core values of the mediation process, the romantic days of mediation will continue.
