AbstractThis article draws upon the author’s experience in teaching and writing on evidence law in Canada over the past 20 years, and periodic teaching of evidence law in Australia over the last 15 years. It therefore takes the stance of an interested ‘outside’ observer of Australia’s evidence laws. There is value in seeing how different jurisdictions approach and deal with the same evidentiary issues.
