Commment Letter re Regulatory Objectives to the ABA Commission on the Future of Legal Services(2015)
This document is the comment letter that I sent to the ABA Commission on the Future of Legal Services regarding the draft regulatory objectives it circulated. It made 3 points: 1) urging the ABA to adopt regulatory objectives, even if members disagreed with the particular items in the ABA's draft since ABA regulatory objectives will encourage jurisdictions to discuss and identify their own regulatory objectives; 2) suggesting a change to the ABA list of objectives if it decided to amend the draft objectives; and 3) encouraging ABA members to remember tat regulatory objectives address the "WHY?" question in the who-what-where-when-why-and-how landscape of lawyer regulation. They do not predetermine answers to other questions such as who should regulate lawyers, who or what should be regulated, or when regulation occurs.
