Abstract

This paper summarises the scheme of rules for various types of amendments to proceedings, and looks particularly at issues concerning amendment to proceedings out of time, including: - the nature of the discretion to be exercised by the court in allowing amendments out of time; - the source of power to order amendments after the running of a relevant time limit; and - the effect of time limits imposed by statutes other than the Limitation of Actions Act Qld.
