A Framework for Evaluating Nontariff Barriers to Trade Related to Sanitary and Phytosanitary Regulation

Abstract

Under recent trade agreements, a two part science and policy test is used to evaluate when a country's sanitary or phytosanitary regulatory regimes constitute illegitimate non-tanff barriers to trade. We present a framework for operationalising this test, focusing on how the SPS regime affects trade flows through differences in compliance costs, which in turn d q a d on the level of regulatory rapprochement between trading partners.
