This paper was presented as a keynote address to “Law as Violence: An Interdisciplinary Conversation” held at Wake Forest University, April 9, 2014. The author thanks the editors of the Wake Forest Law Review and Professor Jonathan Cardi for their invitation and fantastically organized symposium and all of the participants for their inspiring presentations and comments on my talk. I also wish to thank Victoria Robinson, Pat Hilden, Jill Stoner, Keith Feldman, Tony Platt, and Richard Perry for their collaboration on studying the evolving core of mass imprisonment over the past two years.
