Hell On Earth: The Desecration of Sacred Indian Land Needs a Final SolutionExpressO (2007)
AbstractThis article is about the need for protection of Indian sacred sites on government land. I begin with a brief explanation of Indian religion, followed by the failure of Constitutional Free Exercise claims, the failure of statutory remedies, the failure of the so-called “agency approach,” and the bleak outlook of the latest trend of using international human rights law. I examine two current situations in which Indian sacred sites are being desecrated and then I propose a final statutory solution based on Israeli law.
