Abstract
The relations between market freedoms (or economic freedoms) with fundamental rights can be both negative (conflict situations) as positive. In order to study the second type, firstly we try to indentify the similarities and differences between the two categories, and the terminology used by the European Court of Justice. After that we turn our attention to the important judgment Elliniki as a turning point in the positive synergy, and we finish with a small note on the scope of fundamental rights taking into account the judgment Åkerberg
