Abstract
The system of higher education in Australia is complex and diverse. It is also governed
and regulated by a vast array of Commonwealth and State or Territory legislation and
regulations. As an introductory chapter to the diverse legal themes and issues dealt
with in this book, this chapter provides an overview of the composition of the higher
education system in Australia, with the focus on universities, and the legal framework in
which they operate. Consideration is given to the place of higher education in a federal
system of government, the relationship between Commonwealth and State systems, the
incorporation of universities, university governance, quality assurance and funding.
