Abstract
This is a case analysis for publication in the multi-volume series Annotated Leading Cases of International Criminal Tribunals, Volume XVI. The contribution analyzes The Prosecutor v. Januario Da Costa and Mateus Punef, Judgement, The Prosecutor v. Francisco Perreira and Final Judgement, Deputy General Prosecutor for Serious Crimes v. Sisto Barros aka Xisto Barros and Cesar Mendonca. Issues analyzed include, command responsibility and presence, deportation, sufficiency of an indictment, joint criminal enterprise, specificity of conduct and theory of individual criminal responsibility in an indictment, pleading persecution, admissibility of statements of defendant and compliance with norms of other tribunals.
