The Right Way to Amend the Johnson Amendment

Abstract
In this article, Zelinsky argues that rather than the blanket repeal of the Johnson Amendment favored by President Trump, Congress should enact a statutory safe harbor for the internal communications of churches. He asserts that a more targeted reform of the Johnson Amendment would address the legitimate concerns of churches about their First Amendment rights to speak freely, while preventing the tax-exempt sector from becoming a conduit for tax-deductible campaign contributions.
