Abstract
In a new crossover between Brazilian courts, market-specific regulator, and the competition authority – the Administrative Council for Economic Defence (CADE) –, Brazil’s Superior Court of Justice (STJ) temporarily confirmed Cade’s authority to investigate the competition impact of the terminal handling charge adopted by port operators.
