Dangerous Fictions
The Daily Journal (2020)
  • Curtis E.A. Karnow
Abstract
A short review of legal fictions, such as "person" as applied to companies, "deemed" when the meaning is otherwise, as in deemed notice (where there is no notice), and "agreement" or "consent" in contracts where the parties did not actually agree. The article suggests legal fictions which have meanings the opposite of everyday usage are dangerous in the sense that they divide the legal community from the people it serves.
