Abstract
This article examines the various dimensions of intention in criminal law. It sketches the idea that the various "guilt elements" of dolus directus, dolus indirectus, dolus eventualis and culpa cannot be ordered on a (descending) linear scale in terms of seriousness/maliciousness. It is discussed that the ascription of intention should rather be seen as a combination of different factors, and criminal intent should be understood as a multi-dimensional concept as opposed to a monodimensional one (i.e. linear). The discussion is inspired by the ideas of two prominent professors of criminal law with a century apart – Johan C.W. Thyrén and Per Ole Träskman – both of Lund University.
