Court's Decision on Reg BI Lawsuit Could Come Down Near Implementation Date

Abstract
A legal challenge to the SEC's new Regulation Best Interest is scheduled for oral argument in the Second Circuit Court of Appeals for June 2. The smart money is betting that the court will defer to the SEC and uphold the new regulations. This is because the new regulations are not irrational, but intended to preserve smaller investors' access to commission-based financial services. Moreover, the Second Circuit has a history of deferring to the SEC's institutional expertise in securities regulation.
