Connecticut Supreme Court Quotes Dean Page’s “Landmark” Article

Abstract
The Connecticut Supreme Court in State v. Holmes, 334 Conn. 202 (Dec. 24, 2019), extensively quoted Dean Antony Page’s article, Batson’s Blind Spot: Unconscious Stereotyping and the Peremptory Challenge,85 Boston University Law Review 155.  The court, referring to it as both a “leading article on implicit bias” and a “landmark article”, summarized the thesis—due to unconscious bias, Batson “is woefully ill-suited to address the problem of race and gender discrimination in jury selection”–and reviewed Dean Page’s proposals.  Although the court ultimately affirmed Holmes’s conviction under existing law, it also chose to form a specialized task force to propose meaningful changes to jury selection.
