Medical Malpractice Law: The Oklahoma Supreme Court Holds "Merit Affidavit" Requirement Unconstitutional
(2013)
  • Alex Stein
Abstract

The Oklahoma Supreme Court voided the affidavit-of-merit requirement for suits alleging professional negligence, holding that this requirement violates the constitutional prohibition of special laws and creates an unconstitutional burden on access to courts.

I discuss this decision in my e-journal, here: http://steinmedicalmalpractice.com/wall-v-marouk-p3d-2013-wl-2407160-okla-2013.
