Space Tourism : a Synopsis on its Legal Challenges
Abstract
The use of space is addressed & regulated by a number of legal instruments. The current regime, however, was not designed to address commercial activities. It was drafted solely to assist in the progress of governmental use & exploration of outer space. As a result, a number of legal & regulatory concerns arise in relation to commercial space travel & space tourism. The development of such a venture requires a suitable framework regulating its activities. Accordingly, the objective of this study is to evaluate whether the current legal regime can handle the emerging space tourism industry . The nature & the risks involved in this venture, invite a focus on issues of liability. Thus, by using both primary & secondary sources it is necessary to outline & assess the legal framework in relation to a number of vital issues. These include the legal status of space tourists, interferences between air & space law & liability for damage caused to: states, tourists & third parties.
