Abstract
有“機器人王國”美名的日本雖然其科技處於領先地位，但卻不時發生先進機器人與現行法律衝突的情形。道路交通法是機器人進入戶外環境的主要障礙，然而次世代機器人執行任務的場所並非像工廠一樣的結構化環境，而是人類所處的開放環境，要求製造商在封閉環境內研發用於開放環境的機器人顯然不合理。這樣的困境也恰好反映了社會-科技系統中技術物與社會物之間的矛盾，於是一種折衷做法便是從開放環境中分離出機器人特區，以供學術機構和廠商投入開發與實證測試之用。本文從人類和機器人共存的大趨勢切入，以機器人特區和紅旗法比較管制者在面對新興科技風險調控中所出現的兩種正反姿態，並介紹機器人特區制度的歷史與展望。
