Throwing Down the International Gauntlet: Same-Sex Marriage as a Human Right
Abstract
Attached please find my article "Throwing Down the International Gauntlet: Same-Sex Marriage as a Human Right." The article addresses the question of how same-sex marriage might get recognized across international borders as part of customary international human rights law. It does this by trying to show that same-sex marriage is but a small part of a much larger concern for human dignity that customary international human rights law already instantiates and philosophically should instantiate. From there the issue becomes one of incorporation into the domestic law of individual countries. I believe that the article has important implications for international legal interpretation that go far beyond the same-sex marriage issue and should be a valuable contribution to the field of customary international human rights law generally.
