FOIA Response from CBP on Notices to Appear

Abstract
Following a FOIA to CBP for research on a forthcoming report by Penn State Law’s Center for Immigrants’ Rights and the American Bar Association’s Commission on Immigration on the relationship between prosecutorial discretion and Notices to Appear (NTAs), we received a response from CBP. The response includes a few paragraphs about CBP’s “policy” on NTA issuance and more than 1000 pages of tables on NTAs issued by CBP in fiscal years 2011 and 2012. The data is broken down by country of citizenship, date of entry, and time in the United States. We hope that the information clarifies the role CBP plays in issuing NTAs, provides a foundation for analyzing trends, and inspires you to read our report when it is finalized!
