Scuba Diving Buddies: Rights, Obligations, and Liabilities

Despite the common misperception that scuba diving is dangerous, it is actually one of the safer sports. One reason is because divers are encouraged, and at times even compelled, to pair up. Buddies are trained to perform a variety of tasks including assisting in an emergency. This article addresses the important issue of what happens when their failure to act results in death or serious injury and explores whether a diver (or his heirs) can recover damages caused by his partner’s negligence.
