Do Direito Natural ao Direito Fraterno
Abstract
In this study an analysis is made over the paradigms of the Natural Law and the Positive Law, both as guides of the Law Sciences. Later it reflects about a new paradigm – the Fraternal Law. Therefore, it desires to go beyond those formal paradigms to get an informal paradigm, that is, the legal-politic paradigm of the Human Rights. Thus, the challenge of the Law must be a constant renewal for and with the Justice and that the Law must act, beyond men’s reality, to reach a fair attribution.
