The Application of EC Competition Law and the European Convention on Human Rights

Abstract

Academic commentaries on the relationship between EC Competition Law and the ECHR have predominantly found conflict. This paper takes a different view. It examines the ECJ’s application of Articles 6 and 8 ECHR and concludes that, although applying different principles, the ECJ ended up ruling for outcomes that are not radically different from those of the ECtHR on similar cases.
