Psychiatric workplace injury and breach of duty: New South Wales v Fahy

Abstract
The High Court of Australia addresses the issue of psychiatric injury in the workplace, and overturns concurrent findings of breach by lower courts. But a majority of the members of the court reaffirm the continuing validity of the ‘undemanding’ test of foreseeability set out in Wyong Shire Council v Shirt, when read in conjunction with the other factors set out there to determine the nature of the ‘reasonable’ response to risk.
