Abstract
The Court of Appeal in Northern Ireland has recently upheld the application of the right to reside requirement, in relation to child benefit, under EU law – reversing the decision of the Northern Ireland Chief Social Security Commissioner. This ruling is the latest in the lengthy litigation concerning the legality of the right to reside requirement which now dates back a decade to its introduction in 2004.
