Why Do You Do the Things You Do? Clemency for Battered Incarcerated Women, A Decade’s Review

Abstract

This article examines the executive power of granting clemency, particularly in cases involving battered women who kill their abusers. Beginning with an overview of the use of the pardon power by President Clinton at the end of his term, the article then covers clemency granted by the governor of Ohio to 28 battered women in the 1990s. Other governors' use of clemency in cases of battered incarcerated women is also discussed. Finally, the article looks at recidivism in the cases of the Ohio women granted clemency.
