Protecting the Rights of the Plaintiff in Private Antitrust Litigation

Abstract

With the deepening of antitrust legal practice, because of lack of the appropriate legislation to protect the rights of the plaintiffs, resulting in rights protection vacancy , and rights are constantly violated. Thus, it is more and more important to discuss the protection of the plaintiff’s rights in antitrust litigations. Firstly, this article argues the importance of protecting the rights of plaintiffs in private antitrust litigation. Secondly, elaborate the protection of private plaintiffs interms of proof , ensure the advanced execution claim of the plaintiff and protect the private plaintiffs to achieve its claim for damages. Finally, elaborate the special rules apply to the cost of litigation in favor of private plaintiffs.
