Notable Court Decisions Affecting PTO Trademark Practice

Abstract

The past year featured a number of important cases affecting PTO trademark practice. The U.S. Court of Appeals for the Federal Circuit reconciled its case law with that of the Supreme Court on the issue of functionality and reiterated its position regarding trademark protection for book titles. The Trademark Trial and Appeal Board issued its first substantive ruling under the Federal Trademark Dilution Act and the Director of the United States Patent and Trademark Office revised office policy with respect to drawing pages and on according filing dates based on declarations related to missing pages.
