Noteworthy PTO Trademark Decisions

Abstract

This article reviews, the decisions of the Trademark Trial and Appeal Board and the Assistant Commissioner for Trademarks during late 1996 and most of 1997. The decisions of the Board on the issue of trade dress functionality and of the Commissioner relating to intent to use practice are particularly noteworthy.
