Internet, Derechos Fundamentales y Economía Sostenible

Germán M. Teruel Lozano, Junior researcher/Fellow assistant of the University of Murcia

Abstract

INTERNET, FUNDAMENTAL RIGHTS AND SOSTENIBLE ECONOMY: Our society has undergone a real revolution in the hands of the development of communication technologies. Has appeared a new virtual space and Internet has had a special impact in the social, economic and productive model. Against those who have been treated to see in this new space a place in which to assert the myth of the anarchist society, the fact is that Internet needs a regulation. Moreover, Internet needs a "Constitution" asserting the fundamental values and principles. The Legislator must give to Internet a design in accordance with our Constitution. Especially this paper considers the constitutionality of the “Final provision 2” of the Spanish “Sustainable Economy Bill”, which seeks to establish an administrative procedure for censoring websides that violate copyrights.
