Westers recht in ontwikkeling: privaat- en publiekrecht van Rome tot vandaag

Dave De ruysscher, Vrije Universiteit Brussel

Abstract

This book provides an overview of Western and Belgian legal history, from its Roman beginnings to the recent past. It mostly covers topics of private law, especially themes regarding persons and the family (the rights of children and women, marriage and divorce, inheritance rights), land law and the law of obligations. In a first part, the institutional context (sources of law, political regimes) is detailed. In the other parts of the book, the development of private law is analyzed against the background of political, cultural and economic variables and their changing interactions. Much attention has been paid to the contents of the continental ius commune (including canon law) and to the precepts of the 1804 Civil Code.
