Abstract

This Insight examines the Berne and TRIPS arguments raised in the case and evaluates the proposed Settlement's compatibility with these agreements. Incompatibility with either the Berne Convention or TRIPS could lead to a WTO dispute against the United States because TRIPS Article 9 requires that WTO Members comply with almost all of the substantive provisions of the Berne Convention.
