The complexity of the internet makes it fertile ground for misleading or deceptive conduct. One area of potential confusion is domain name registration. In .au Domain Administration Ltd v Domain Names Australia Pty Ltd [2004] FCA 424 the first respondent sent out domain name notices in the mail that played on this confusion. The respondents were accused of being in breach of s 52 of the Trade Practices Act 1974 (Cth) (the Act), as well as contravening s 64 (2A) of the Act which prohibits demands for payment in respect of unsolicited services.
